These are the cases in which you are not entitled to receive the food allowance.

The meal allowance - or meal subsidy - is the amount paid by the company to a worker, for each day worked, in order to compensate for daily meal expenses incurred during a work day.

According to the law, the "meal allowance does not have, as a rule, a salary or remuneratory nature, unless its value is higher than the amount considered normal or when, by force of the contract or labor practices, it is considered an integral part of the worker's remuneration".

However, there are specific situations in which you lose the right to receive the meal subsidy, such as vacation days, holidays, absences, or other days not worked.

The Saldo Positivo website by Caixa Geral de Depósitos lists and explains the cases in which this subsidy is not received: 

  • Vacation time
  • Medical leave;
  • Marriage license;
  • Parental leave;
  • Absence due to mourning or assisting family members.  
  • Exercise of the right to strike.
  • Unjustified absences.
  • Application of preventive suspension and compliance with disciplinary penalties.
