
Do all workers receive holiday pay? When should it be paid?

The lawyer clarifies that all workers entitled to vacation also have a proportional vacation allowance. Therefore, there will only be no vacation allowance when the employment contract is less than one month.
In the remaining cases, there is always the right to receive a holiday allowance "comprising the basic salary and other remuneration elements that are a counterpart to the specific way of performing work, corresponding to the minimum duration of holidays", as provided in Article 264, paragraph 2 of the Labor Code and "without prejudice to a more favorable provision for the worker provided for in a collective labor regulation instrument or in the employment contract", can be read in the section.
And when should it be paid?
Must be paid before taking vacation time, unless agreed between the parties that it will be paid at a different time.
"If holidays are taken in installments, the proportional amounts corresponding to each holiday period must be paid before the respective enjoyment of the holidays, unless, as mentioned, there is an agreement between the parties for the payment of the subsidy in a specific period," it also reads.
