How to request Compensatory Benefits for subsidies after a sick leave?

You can request Compensatory Allowances from Social Security if you have been on sick leave for more than 30 days in 2024, for holiday and/or Christmas bonuses.

"They are money values that are paid to compensate for Christmas, holiday subsidies, or other similar aspects that the worker did not receive, in whole or in part, from the employer, for having been unable to work due to illness or subsidized parenthood, for a period equal to or greater than 30 consecutive days," as read in a practical guide from Social Security. To be entitled to Compensatory Benefits, it is necessary to be:

  • Employee;
  • Manager or administrator of legal entities (MOE'S), if the right to the respective subsidies is proven and the remaining working conditions are met.

And to submit the request, you must access Social Security Direct - Employment - 'Compensatory payments for vacation and Christmas benefits'.

From there, your request is registered and later analyzed by Social Security services.

Note that you must request compensatory benefits within six months from:

  • January 1 of the year following the one in which holiday and Christmas bonuses were due from the employer.
  • End date of the employment contract if there has been termination of the contract.
